
LANDMESERE & PARTNERS is pleased to announce the successful conclusion of a case in which the State Revenue Service (SRS) has decided not to proceed with tax recovery proceedings against our client. The case started with a warning from the SRS in October 2025, in which our client was ordered to pay the tax and levy liabilities of another company “X”. The SRS based this requirement on the assumption that a transfer of the company's activities might have taken place within a certain period of time. Such situations are particularly sensitive in practice as they can pose a significant financial and reputational risk to a company if liability for the obligations of another legal entity is wrongly imposed.
Representing the client's interests, the law firm conducted an in-depth analysis of the circumstances of the case, developed the legal position and prepared detailed explanations to the SRS and, in parallel, to the Administrative District Court, where our client's official was included in the list of persons at risk on the basis of this pre-decisional transfer of legal personality. Evidence was gathered and presented which clearly demonstrated that there were no legal grounds to believe that our client had taken over the liabilities of another company. Particular attention was paid to the presentation of the facts, the analysis of the transactions and the application of the regulatory framework to ensure a clear and legally defensible defence of the client's position.
After a comprehensive assessment of all the case files, including the explanations we prepared and the evidence we submitted, the SRS decided not to proceed with the recovery case. This means that our client is not held liable for the tax liabilities of another company and the recovery proceedings have been terminated in full.
